Court Compels INEC To Accept PDP’s List In Ogun Against Kasamu's List


The Federal High Court sitting in Abuja has mandated the Independent National Electoral Commission (INEC) to accept the Ogun State People’s Democratic Party (PDP) National Assembly Candidates submitted by the National Executive Council.

The National Assembly candidates under the structure of Sikirulai Ogundele had earlier petitioned the Abuja High Court, challenging the stance of INEC on accepting the list of the Bayo Dayo led group.

The applicants in one of their submissions described the primaries conducted by the Bayo Dayo’s group as a ‘Mushroom’ one, with electoral deficiency.

In their prayers, the National Assembly candidates jointly declared to the court that stipulations of the party constitution empowers the National Executive Council of the party as the only statutory organ recognised to supervise, regulate and conduct primary elections to all elective positions.

The applicants requested an order of perpetual injunction from the court restraining INEC from accepting any other list other than that submitted by the National Executive Council of the party.

In the ruling, Hon. Justice Mohammed said since the defendant had been duly served with the originating process of the claimants as well as opportunity to file a defence to same and be heard, and the defendant has neither appeared nor fixed any process, the law is that it is deemed to have conceded to the claimants’ suit.

“This court has no hesitation in answering all the questions for determination, raised in the claimants originating summons and granting the declaratory and other orders sought by the Claimants therein.”

“Accordingly, the 10 questions raised in the originating summons are hereby answered in favour of the claimants and all the declaratory and other orders sought by the claimants in this suit are hereby granted. In other words, Judgement is hereby entered in favour of the claimants against the defendant as per the original summons.” Justice Mohammed added.

Do Not Campaign in Ogun State - INEC Tells Buruji Kashamu

Today, in a letter written by the Independent National Electoral Commission (INEC), signed by its Director of Legal Services, Mrs Oluwatoyin Babalola to Senator Buruji Kashamu in Ogun State, content of which stops Kashamu not to campaign for any political posts in the state. Copy of the letter which was not released for publicity by Newsmen richly detailed certain reasons with legal references why the Senator has been asked to desist from his campaign plans.

OMO ILU FOUNDATION CONSOLES KASHAMU

In his residence, Buruji Kashamu received members of Omo Ilu Foundation who came to console him after court's reaffirmation of his expulsion from the Peoples Democratic Party. The Delegation of Omo Ilu Foundation on consolation trip to Buruji Kashamu said they were appointed to pay a visit to their boss, Senator Buruji Kashamu and encourage him. Leader of the Delegation Ade Alatishe however, pointed out that the Omo Ilu Foundation may have to move to another party, thanking God that everything happened when they still have other opportunities to take advantage. In his own speech to members of Omo Ilu Foundation, Sen Buruji Kashamu asked his followers not to relent in their efforts as they are set to move on in another political party. "If we are asked to leave, it is not the end as PDP is not the only platform on which we can contest elections", Kashamu said.
